TERMS OF SERVICE
SECTION 1 - OVERVIEW
Welcome to Shop CabCaddy. Shop CabCaddy is a brand operated by MNCK Ventures, LLC. The terms “we,” “us,” and “our” refer to Shop CabCaddy and MNCK Ventures, LLC.
Shop CabCaddy operates this website and store, including the information, content, features, tools, products, and services made available through it, collectively referred to as the “Services.” Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They include important information regarding orders, product use, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access the Services.
SECTION 2 - ELIGIBILITY AND USE OF THE SERVICES
By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have obtained the consent of a parent or legal guardian where required by applicable law.
You may not use our products or Services for any unlawful or unauthorized purpose, nor may you violate any applicable laws or regulations through your use of the Services.
You are responsible for maintaining the confidentiality of any account information associated with your use of the Services and for all activities conducted through your account.
A violation of these Terms may result in the suspension or termination of your access to the Services.
SECTION 3 - OUR PRODUCTS
We make reasonable efforts to accurately describe and display our products. However, product colors, finishes, materials, dimensions, and appearance may vary slightly because of manufacturing tolerances, natural material variation, lighting, photography, screen settings, and product updates.
Product descriptions, measurements, compatibility examples, and vehicle references are provided for general guidance. Customers are responsible for reviewing product dimensions, measuring their vehicle where applicable, and confirming that the selected product, size, configuration, scent, or mounting style is appropriate before ordering.
Vehicle fit and compatibility may vary by vehicle, center-console dimensions, visor construction, air-vent design, rearview-mirror configuration, and other interior features. Unless expressly stated otherwise, a product described as adjustable or broadly compatible is not guaranteed to fit every vehicle.
SCC Air essential oils are intended only for use with compatible cedar diffusers. They are not intended for ingestion or topical use. Essential oils should be applied away from vehicle surfaces, upholstery, plastics, electronics, clothing, skin, and eyes. Undiluted oils may stain or damage certain materials. Customers must follow all instructions, warnings, and care information provided with the product.
Keep essential oils and small product components out of reach of children and pets.
All product descriptions, specifications, prices, and availability are subject to change without notice. We may discontinue products or limit the quantity available to any person, household, geographic region, or jurisdiction.
SECTION 4 - ORDERS
When you place an order, you are making an offer to purchase the products in your cart. We reserve the right to accept, reject, limit, or cancel an order for reasons including inventory availability, payment concerns, suspected fraud, pricing or listing errors, shipping restrictions, or an inability to fulfill the order.
An order is not considered accepted until payment has been authorized and we have confirmed the order.
Please review your order carefully before submitting it. Cancellation requests must be submitted within one hour of placing the order by emailing info@mnckventures.com. We will make reasonable efforts to accommodate an eligible request, but cancellation is not guaranteed once processing or fulfillment has begun.
Orders that have already been fulfilled or shipped cannot be canceled and are subject to our Return and Refund Policy.
If we reject, modify, or cancel an order, we will attempt to notify you using the email address, billing information, shipping information, or telephone number provided with the order.
Purchases are subject to our Return and Refund Policy. Products are intended for personal or household use unless we have separately agreed to a wholesale or commercial transaction.
SECTION 5 - PRICES, BILLING, AND ACCOUNT INFORMATION
Prices displayed through the Services are subject to change without notice.
We reserve the right to correct pricing errors, product information, promotions, discounts, shipping charges, or other inaccuracies, including after an order has been submitted. Where required by applicable law, we will provide appropriate notice or an opportunity to cancel an affected order.
You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all transactions made through the Services.
You agree to promptly update your information when necessary so that we can complete transactions and contact you regarding your orders.
You represent that you are authorized to use any payment method submitted in connection with a purchase.
SECTION 6 - SHIPPING AND DELIVERY
Orders are processed and shipped in accordance with our Shipping Policy.
Processing times and delivery dates are estimates and are not guaranteed. Carrier delays, severe weather, holidays, customs processing, incorrect addresses, service interruptions, and other circumstances outside our reasonable control may affect delivery.
Customers are responsible for providing a complete and accurate shipping address. We cannot guarantee that an address can be changed after an order has entered processing.
If we are unable to ship an order within the stated or legally permitted timeframe, we will contact the customer and provide the options required by applicable law.
Risk of loss passes to the customer when the shipping carrier records the order as delivered, except where applicable law requires otherwise.
Customers should contact info@mnckventures.com promptly if an order arrives damaged, appears lost, contains the wrong item, or is missing components.
SECTION 7 - RETURNS AND REFUNDS
Returns, refunds, exchanges, and related eligibility requirements are governed by our Return and Refund Policy.
Customers are responsible for reviewing the Return and Refund Policy before making a purchase.
Nothing in these Terms or our Return and Refund Policy limits any rights that cannot legally be excluded or restricted under applicable consumer protection laws.
SECTION 8 - INTELLECTUAL PROPERTY
The Services and their contents, including text, graphics, logos, product names, product designs, photographs, videos, illustrations, website content, branding, and other materials, are owned by or licensed to Shop CabCaddy or MNCK Ventures, LLC and are protected by applicable intellectual property laws.
You may access and use the Services for personal, non-commercial purposes.
You may not copy, reproduce, distribute, modify, publish, sell, license, exploit, reverse engineer, or create derivative works from any portion of the Services or our proprietary materials without prior written permission, except where applicable law expressly permits such activity.
No license or right to use any trademark, trade name, logo, or other intellectual property is granted by your use of the Services.
SECTION 9 - PROHIBITED USES
You may not use the Services or their content:

(b) to solicit others to perform or participate in unlawful acts;

(f) to submit false, misleading, or fraudulent information;
(g) to upload or transmit viruses, malicious code, or other harmful technologies;
(h) to collect or track the personal information of others without authorization;
(i) to spam, phish, scrape, crawl, or interfere with the normal operation or security of the Services;
(j) to circumvent or attempt to circumvent security features of the Services; or
(k) to use the Services in any manner that could damage, disable, overburden, or impair the Services.
We reserve the right to suspend or terminate access to the Services for violations of this Section or these Terms.
SECTION 10 - THIRD-PARTY TOOLS, SERVICES, AND LINKS
The Services may provide access to tools, applications, payment processors, shipping providers, websites, or other services operated by third parties.
We do not control all third-party services and are not responsible for their content, availability, practices, policies, security, or performance.
Your use of third-party services may be subject to separate terms and policies established by those third parties.
The inclusion of a third-party link or service does not necessarily imply endorsement.
You should review the terms and policies of applicable third parties before engaging in transactions or providing personal information through their services.
SECTION 11 - RELATIONSHIP WITH SHOPIFY
Shop CabCaddy is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases made through our store are transactions directly between you and Shop CabCaddy.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale between you and Shop CabCaddy, including injury, damage, or loss resulting from products or services purchased through our store.
To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions with Shop CabCaddy.
SECTION 12 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information relating to your access to and use of the Services.
Information submitted through our store may be transmitted to Shopify and other service providers, including providers located outside the jurisdiction where you reside, when necessary to operate, provide, secure, and improve the Services.

You grant Shop CabCaddy and MNCK Ventures, LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, display, distribute, and otherwise use submitted materials in connection with operating, marketing, and promoting our business and Services, subject to applicable law.
We are not obligated to maintain submissions in confidence, provide compensation for submissions, or respond to submissions unless separately agreed in writing.
You may not submit content that is unlawful, defamatory, abusive, obscene, fraudulent, infringing, or otherwise violates the rights of another person or entity.
SECTION 14 - ERRORS, INACCURACIES, AND OMISSIONS
Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery times, availability, or other matters.
We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice, subject to applicable law.
We are not obligated to update, amend, or clarify information except as required by law.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
We do not warrant that every product will be suitable for every vehicle, application, environment, or intended use.
Natural materials, including cedar, may vary in grain, color, texture, scent absorption, and appearance. Such natural variation is not considered a defect.
Except as expressly provided by us in writing or required by applicable law, we disclaim all warranties and conditions, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties, so portions of this Section may not apply to you.
SECTION 16 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Shop CabCaddy, MNCK Ventures, LLC, and their owners, officers, employees, contractors, affiliates, agents, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to your use of the Services or products.
This includes, without limitation and where permitted by law, loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, property damage, vehicle damage, or similar damages arising from the use or inability to use the Services or products.
To the fullest extent permitted by applicable law, our total liability for any claim arising from or relating to a product, order, or the Services will not exceed the amount you paid to us for the product or order giving rise to the claim.
The limitations in this Section do not apply to liability that cannot legally be excluded or limited.
SECTION 17 - INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Shop CabCaddy, MNCK Ventures, LLC, and their owners, officers, employees, contractors, affiliates, agents, suppliers, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, misuse of the Services or products, violation of applicable law, or infringement of the rights of another person or entity.
SECTION 18 - TERMINATION
These Terms remain effective unless terminated by you or us.
You may terminate your agreement with these Terms by discontinuing use of the Services.
We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful conduct, or used the Services in a manner that may harm us, our customers, or third parties.
Any obligations and liabilities incurred before termination will survive termination where appropriate.
Sections that by their nature should survive termination will remain effective after termination.
SECTION 19 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law and the unenforceable portion will be considered severed from these Terms.
Such a determination will not affect the validity and enforceability of the remaining provisions.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies or operating rules posted through the Services, constitute the entire agreement between you and us regarding your use of the Services and supersede prior or contemporaneous agreements and communications relating to the Services.
SECTION 21 - GOVERNING LAW
These Terms of Service and any separate agreements through which we provide the Services are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law principles.
Nothing in these Terms limits any rights or protections available to consumers under applicable law.

We reserve the right to update, modify, or replace these Terms by posting revised Terms through the Services.
The “Last updated” date at the top of these Terms indicates when the Terms were most recently revised.
Changes become effective when posted unless otherwise stated or required by applicable law.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
